Ruling Expected On California's Anti-Gay Marriage Bill, Proposition 8

I have spent the last half an hour in my office with the door closed weeping with joy. Fred Schwartz sent me a video of Representative John Lewis a man whom I both admire and adore arguing against the Defense of marriage Act on the floor of the House in 1996. Once I’d seen this the tears went from sobs to a joyful flood.

I cannot write this brief post without the details of the two decisions. In the DOMA case, United States v. Windsor there was a 5-4 decision with Justice Kennedy writing the opinion joined by Kagan, Sotomayor, Breyer and Ginsburg. In the Prop 8 case from California, the question was about the legal standing to appeal the decision of the District Court in California regarding an overturn of the Prop 8 vote which changed the California constitution. This opinion was written by Chief Justice John Roberts and was joined by Scalia, Kagan, Breyer and Ginsburg.
