THE UNIVERSAL DECLARATION OF HUMAN RIGHTS

PREAMBLE

Whereas recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world,

Whereas disregard and contempt for human rights have resulted in barbarous acts which have outraged the conscience of mankind, and the advent of a world in which human beings shall enjoy freedom of speech and belief and freedom from fear and want has been proclaimed as the highest aspiration of the common people,

Whereas it is essential, if man is not to be compelled to have recourse, as a last resort, to rebellion against tyranny and oppression, that human rights should be protected by the rule of law,

Whereas it is essential to promote the development of friendly relations between nations,

Whereas the peoples of the United Nations have in the Charter reaffirmed their faith in fundamental human rights, in the dignity and worth of the human person and in the equal rights of men and women and have determined to promote social progress and better standards of life in larger freedom,

Whereas Member States have pledged themselves to achieve, in co-operation with the United Nations, the promotion of universal respect for and observance of human rights and fundamental freedoms,

Whereas a common understanding of these rights and freedoms is of the greatest importance for the full realization of this pledge,

Now, Therefore THE GENERAL ASSEMBLY proclaims THIS UNIVERSAL DECLARATION OF HUMAN RIGHTS as a common standard of achievement for all peoples and all nations, to the end that every individual and every organ of society, keeping this Declaration constantly in mind, shall strive by teaching and education to promote respect for these rights and freedoms and by progressive measures, national and international, to secure their universal and effective recognition and observance, both among the peoples of Member States themselves and among the peoples of territories under their jurisdiction.

Article 1.

All human beings are born free and equal in dignity and rights.They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood.

Article 2.

Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status. Furthermore, no distinction shall be made on the basis of the political, jurisdictional or international status of the country or territory to which a person belongs, whether it be independent, trust, non-self-governing or under any other limitation of sovereignty.

Article 3.

Everyone has the right to life, liberty and security of person.

Article 4.

No one shall be held in slavery or servitude; slavery and the slave trade shall be prohibited in all their forms.

No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.

Article 6.

Everyone has the right to recognition everywhere as a person before the law.

Article 7.

All are equal before the law and are entitled without any discrimination to equal protection of the law. All are entitled to equal protection against any discrimination in violation of this Declaration and against any incitement to such discrimination.

Article 8.

Everyone has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law.

No one shall be subjected to arbitrary arrest, detention or exile.

Article 10.

Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him.

Article 11.

(1) Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defence.
(2) No one shall be held guilty of any penal offence on account of any act or omission which did not constitute a penal offence, under national or international law, at the time when it was committed. Nor shall a heavier penalty be imposed than the one that was applicable at the time the penal offence was committed.

Article 12.

No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation. Everyone has the right to the protection of the law against such interference or attacks.

Article 13.

(1) Everyone has the right to freedom of movement and residence within the borders of each state.
(2) Everyone has the right to leave any country, including his own, and to return to his country.

Article 14.

(1) Everyone has the right to seek and to enjoy in other countries asylum from persecution.
(2) This right may not be invoked in the case of prosecutions genuinely arising from non-political crimes or from acts contrary to the purposes and principles of the United Nations.

Article 15.

(1) Everyone has the right to a nationality.
(2) No one shall be arbitrarily deprived of his nationality nor denied the right to change his nationality.

Article 16.

(1) Men and women of full age, without any limitation due to race, nationality or religion, have the right to marry and to found a family. They are entitled to equal rights as to marriage, during marriage and at its dissolution.
(2) Marriage shall be entered into only with the free and full consent of the intending spouses.
(3) The family is the natural and fundamental group unit of society and is entitled to protection by society and the State.

Article 17.

(1) Everyone has the right to own property alone as well as in association with others.
(2) No one shall be arbitrarily deprived of his property.

Article 18.

Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship and observance.

Article 19.

Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers.

Article 20.

(1) Everyone has the right to freedom of peaceful assembly and association.
(2) No one may be compelled to belong to an association.

Article 21.

(1) Everyone has the right to take part in the government of his country, directly or through freely chosen representatives.
(2) Everyone has the right of equal access to public service in his country.
(3) The will of the people shall be the basis of the authority of government; this will shall be expressed in periodic and genuine elections which shall be by universal and equal suffrage and shall be held by secret vote or by equivalent free voting procedures.

Article 22.

Everyone, as a member of society, has the right to social security and is entitled to realization, through national effort and international co-operation and in accordance with the organization and resources of each State, of the economic, social and cultural rights indispensable for his dignity and the free development of his personality.

Article 23.

(1) Everyone has the right to work, to free choice of employment, to just and favourable conditions of work and to protection against unemployment.
(2) Everyone, without any discrimination, has the right to equal pay for equal work.
(3) Everyone who works has the right to just and favourable remuneration ensuring for himself and his family an existence worthy of human dignity, and supplemented, if necessary, by other means of social protection.
(4) Everyone has the right to form and to join trade unions for the protection of his interests.

Article 24.

Everyone has the right to rest and leisure, including reasonable limitation of working hours and periodic holidays with pay.

Article 25.

(1) Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control.
(2) Motherhood and childhood are entitled to special care and assistance. All children, whether born in or out of wedlock, shall enjoy the same social protection.

Article 26.

(1) Everyone has the right to education. Education shall be free, at least in the elementary and fundamental stages. Elementary education shall be compulsory. Technical and professional education shall be made generally available and higher education shall be equally accessible to all on the basis of merit.
(2) Education shall be directed to the full development of the human personality and to the strengthening of respect for human rights and fundamental freedoms. It shall promote understanding, tolerance and friendship among all nations, racial or religious groups, and shall further the activities of the United Nations for the maintenance of peace.
(3) Parents have a prior right to choose the kind of education that shall be given to their children.

Article 27.

(1) Everyone has the right freely to participate in the cultural life of the community, to enjoy the arts and to share in scientific advancement and its benefits.
(2) Everyone has the right to the protection of the moral and material interests resulting from any scientific, literary or artistic production of which he is the author.

Article 28.

Everyone is entitled to a social and international order in which the rights and freedoms set forth in this Declaration can be fully realized.

Article 29.

(1) Everyone has duties to the community in which alone the free and full development of his personality is possible.
(2) In the exercise of his rights and freedoms, everyone shall be subject only to such limitations as are determined by law solely for the purpose of securing due recognition and respect for the rights and freedoms of others and of meeting the just requirements of morality, public order and the general welfare in a democratic society.
(3) These rights and freedoms may in no case be exercised contrary to the purposes and principles of the United Nations.

Nothing in this Declaration may be interpreted as implying for any State, group or person any right to engage in any activity or to perform any act aimed at the destruction of any of the rights and freedoms set forth herein.

The title applies to both those who are willing to commit violence in the name of a broken and fundamentally flawed belief that they are somehow closer to the Creator of the Universe than anyone else based solely on their traditions of worship and to those who because of their political ideology feel that they are morally superior, superior in class and are superior because of the random luck associated with where they were born [in this case this would be the United States of America].

For the former you can see the ignorance and arrogance of religion based hatred in the actions of Somali terrorists who feel they are doing the work of the Creator by shooting up a shopping mall in Nairobi, Kenya and killing 68 people. The same ignorance and arrogance comes from the Right ideologically who are angered that the suffering of their religion of convenience is being ignored in Pakistan after Islamic apostates bombed a Christian church in Peshawar. Yes, there is outrage that the killing of large numbers of what Conservative Americans feel is the “one true religion” half a world away is more important than an ongoing hostage crisis a quarter of a world away. In the politically poliraized United States of America it has gotten this bad.

I hold an example one of the moral exemplars of skewed belief in religion, class and exceptionalism from the Right in the United States in the form of Christian Post op-ed contributor Rachel Alexander. In her post, littered with nuggets of class hatred, bigotry and malice toward many for the benefit of keeping aging conservative base voters from thinking about their soon to come demise at the hands of the undefeated inevitability of Death, Alexander makes this claim:

For too long, the left has held up the poor as an emotional lure to get knee-jerk support for their policies. It has worked, and now the poor have everything available to them, while the middle class is going without. The poor receive food stamps and can buy steak, fast food, and expensive food that the lower middle class cannot afford. The poor qualify for Medicaid to cover their healthcare, while the middle class is stuck with unaffordable Obamacare. The poor can live in Section 8 free or reduced income housing. The lower middle class has no such assistance and instead has been hit with foreclosures.

This is not a new tack for those on the political Right in America. The appeal to base voters that the Left has no substance and can only appeal to the emotions of their voters has often been trotted out in times of electoral peril by the Right. I would only have to point out the worship of armed men and women who go to war as demi-gods, reverence for a dyed piece of cloth as if were some sort of living divine icon and the notion that the Creator of the Universe meant that people born an ocean away from the land in which they live now would become exceptional if they only took that land away from the inhabitants of the age and brought in slave labor from yet another continent. Alexander earns the right to be devoured by the rational also by simply appealing to the deity she and most other Conservatives worship one made of gold and firing cruise missiles out of every orifice and giving birth to lies so numerous they cannot be seen by the faithful as anything other than the Truth. The poor cannot use their SNAP benefits to buy fast food as it is cook and is one of the many things [like alcohol tobacco and toilet paper] that are prohibited SNAP items. The writer also forget that the average SNAP benefit is around $133 per month/ per person in a household. Rachel Alexander is too “moral” to state that she just wants those who, do not worship the violence of guns as she does, is not white and upper middle class like she is, and does not believe in a certain deity as she does, to simply slink off and starve to death. There are millions of those who agree with Rachel Alexander in America and despite their cowardice regarding physical violence they are just as deadly and dangerous with their words and lack of intellectual honesty as the hijackers who destroyed the facade of American exceptionalism on 11 September 2001.

MINORITY REPORT: MARK NOONAN CANNOT BE AS “CATHOLIC AS HE WANTS TO BE”

Mark Noonan asks a trap question at B4V:

“Which is worse: a democracy where minorities are oppressed or a dictatorship where minorities are protected?”

His question is really, “Do you dislike Obama more or miss Reagan more?” Since America isn’t and never will be a “democracy” the question is moot. Since the United States has checks and balances across the three branches of government it is not a dictatorship no matter how much white religious conservative dislike the first person of color elected as Chief Executive of the United States Government. And finally since Catholicsim isn’t and will never be the State religion of the United States, Mark Noonan can once again go and pound sand.

I replied thusly:

From what I gather here Mark in your post you seem to be admitting that those with conservative values, regardless of race, are now the minority in America. I think that as you define what conservative is you are accurate there. I also agree that you have the right to be as “Catholic as you want to be.” What likely, and I am just guessing here, irks you is that you cannot carry out your mission of being as Catholic as you want to be in places like the office where you work. Until such activity is allowed in the workplace you will never feel that you have all the religious rights that you feel you deserve. I have to say that you do have the right to be as Catholic as you want to be 24/7/365 but your employer also has a right to fire you for disrupting his office or for any other reason he needs to rid himself or herself of a destabilizing individual in their corporate midst. Same would apply to a Muslim, a Hindu, a Protestant, a Jew, a Zoroastrian, a Satanist, a Jainist or an Atheist. I love the Constitution more than you do Mark Noonan and I’m not even American!

New York Archbishop Timothy Dolan has made a statement this morning clarifying the statements made by Pope Francis I yesterday as the Pontiff returned to the Vatican from his visit to Brazil. The Pope said when asked about a “gay lobby” within the Vatican, “If someone is gay and he searches for the Lord and has good will, who am I to judge,” prompting Archbishop Dolan to clarify with, “We can’t judge people. we can judge actions; certain actions are immoral. In no way should this be interpreted as a change in church doctrine.”

Despite the clarification from Dolan the words of Francis I mark a significant shift in hos the Roman Catholic Church views homosexuals in the post Benedict XVI era. Benedict XVI one year prior to his visit to Brazil in 2006 wrote regarding homosexuality is, “a strong tendency ordered toward an intrinsic moral evil.” This statement and other paraphrases have been parroted by right wing Catholic bloggers on matters political time and time again.

I ask a lot of questions in my job and no one can ever say that I am not opinionated. I am an unapologetic Progressive/Socialist. I think women should rule Terra for the next 500 just so they can formulate a plan to fix all the ills that men have done in the first 6000 years of civilization. I believe no child on Terra should ever go to bed hungry, thirsty or in fear that someone will come to their home and take them away. My beliefs motivate me to attempt great things every day but in the great scheme of thing I have no idea really if I have the right answers. Like everyone else I just know what makes me feel good–in the present. I say all of this begging a question, “Why can’t there be peace on Terra?” That’s a question lawyers, politicians, doctors, priests, rabbis, imams, the blind, the lazy, the rich, the poor, men, women and children have been asking since time immemorial. I still look for some clue to the answer to that nagging question everyday. This morning I got a fleeting glimpse of the shadow of the answer as is escaped out a window on the Internet from a young woman Tempest Adore:

This was originally meant to be a Facebook status, but I got so into it, and 6 pages is a bit too much to post on Facebook. Honestly, I haven’t read over it, I just wrote it and posted it. I also started to falter towards the end, my mindset seemed to have changed, so I might go back and edit. And it’s not complete, I stopped mid-sentence, so I have to add the ending.

Seriously, what is going on with the world lately? America especially. I have witnessed more racism, homophobia, religious intolerance, bigotry, hypocrisy, and just plain ignorance and hate more lately than ever. We are all people.

When it comes to homophobia.. gay, straight, bi, trans, pan, poly, whatever: we’re all looking for love. Where we find it shouldn’t matter to anyone else who isn’t directly involved. It does NOT affect you, STOP affecting them. If you don’t like it, don’t engage in it. Don’t gawk at it. If you go to an art store and don’t like one of the paintings, do you FIGHT to have it removed? No, you move on and let others who think and see differently enjoy it. Love is Love. In a world full of war and hate and violence and despair, we should be promoting and fighting for EVERY kind of love, instead of fighting against it and causing more anguish.

When it comes to race.. we’re all fucking human. I understand being patriotic, but EVERY race has done amazing world-changing things; EVERY race has done horrible, evil things; EVERY race is just trying to live, the same as every OTHER race, just in their own way. Who cares?!

When it comes to religion.. faith can be a very powerful thing that saves lives and helps people find themselves and be at peace with themselves. However, faith is personal. EVERYONE’s faith is different, even if you share the same religious beliefs. If people are at peace with themselves, that is all that matters. Just because they don’t believe the same as you, or the same way that you do, does not make them wrong. We only have so many years to live; let people do it their own way. THEIR afterlife is not YOUR concern. And, even if by some chance one specific religion is right and all the others ARE wrong, let those people find that out themselves. I’m sorry if this offends anyone, but I do not believe ANY god would turn someone away simply because they lived their life believing in their own way, finding their own faith. There are SO MANY different religions, they ARE NOT and should NEVER BE law. No matter WHAT, it is never OK to force your views on others, and make them live their lives YOUR way. Nor is it OK to hate them, or shun them, or disrespect them, simply because they are finding their happiness a different way than you.

When it comes to bigotry.. everything I’ve said above applies. If everyone were the same, we would not have come this far. And honestly, if you have so much hate, or fear, or sadness inside of you (which you must to be so disapproving), maybe you should take a step back and realize that those people ARE happy, why aren’t you? What are you missing from your own life that you’re trying to fill by controlling, judging, or sabotaging others’?

As for the hypocrisy.. seriously? No one is perfect. And the main point of this, NO ONE IS THE SAME. You cannot blame someone for making the same mistakes you have. Even if you made them in different ways. We all sin, and no one sin is greater than any other, mainly because no one person is greater than any other. The world, and life, is not simple; it is not black and white; it is not meant to be simply right or wrong. Life itself is a gray area. Don’t justify your sin and disparage another’s, because everyone has different reasons and thoughts and beliefs and feelings. What is right for you may not be right for another. You can not forgive yourself without in turn forgiving others.
 
 

By far this is the best explanation of a path to real happiness that I have ever come across. It has brightened my day and it is early here on the East Coast of the United States as I wrap up my vacation in DC. So today I, while among the Living, will share the love. You never know I might be the guy who buys you a cold drink on a day when it’s going to be a sweltering 100 plus degrees out. Or I might just be the guy who thanks you and listens while we ride on the Metro. Either way from what tempest Adore has written I understand that love is more than desire it is a willingness to give up a little of yourself to learn about another.

THE MEDITATORS SPEAK: ALLEN WEST NEEDS TO UNDERSTAND THE POWER OF WORDS

The Collective and The Meditators opine that words are powerful engines of change in any Society. As an icon of American and global popular culture on Terra, Lady Gaga is fully aware of the power of Free Speech and tapped into that power at a New York City Gay Pride rally on 30 June 2013. Toward the end of her rendition of the United States’ National Anthem, Lady Gaga changed the words of the last stanza from the the “home of the brave” to the “home of the gays.”

The Republican former member of the House of Representatives had this as a response which is more telling that the artistic license taken by Lady Gaga:

“Having served in the US Army for 22 years alongside some very brave men and women, I find Lady Gaga’s defiling of our National Anthem reprehensible. We are the land of the free because America has always been the home of the brave from Lexington and Concord to Kandahar. This young lady should be taken to Ft. McHenry and given a history lesson as to why Francis Scott Key wrote those words incredible words. In this week where we remember the 150th anniversary of the Battle of Gettysburg and the 237th anniversary of our Independence is further evidence of the level of ignorance and disrespect some have for our national character. She and all those who cheered her abomination should be ashamed and apologize to every serving and retired member of our Armed Services. But perhaps I ask too much…”

To begin Lady Gaga does not owe anyone an apology for this appeal to civil rights for the LGBTQ community in the United States; We, Ourselves of The Collective and The Meditators do feel that the former congressman asks too much. We opine that Allen West should cease his reverence for war and embrace the struggle for the freedom of people to pursue happiness which is also to be celebrated on American Independence Day. Lady Gaga in her rendition of the Star Spangled Banner was neither ignorant of history, nor was she disrespectful of those who have fought and died for freedom. It appears that West feels that those that died in Gettysburg would feel that only certain people were the inheritors of the victory earned by the shedding of that blood while failing to understand that the Union soldiers who died to bring an end to slavery were fighting for the rights of his own ancestors to be equal partners in the America Experience. America has been the home of the gay since 1776 and would be known to have been had there not been the same manner of intolerance inspired by conservative religion based values that have no place in government then as he holds. To use the word “reprehensible” [bringing or deserving severe rebuke] bears out the disdain West has for anyone who does not fit into his worldview which is based on intolerance not only for members of the LGBTQ community but for Human Rights in general as his military record at the end of his career shows clearly.
