THE DAILY EPIC FAIL: A CONSERVATIVE TRIES TO EXPLAIN WHY THE RELIGIOUS FREEDOM RESTORATION ACT IN INDIAN HARMS NO ONE

There was a time, not too long ago, when Mark Edward Noonan of Blogs For Victory infamy, saw himself as a potential candidate for public office. I believe we here at The Dis Brimstone-Daily Pitchfork were a bit too harsh on him and for reasons which have never quite become clear he bowed out aborting his campaign before it could be brought forth to the political world. That event likely saved many of you who read this blog a virtual smörgåsbord of gaffes, missteps and other laughable events on Mr Noonan’s part.

This brings me to the most recent attempt on the part of the GOP in a state legislature to turn 2015 back into 1915. Indiana has passed and Governor Mike pence has signed the Indiana Religious Freedom Restoration Act. This bill is very similar to the federal version which was passed and signed in 1993. The main difference between the Indiana law and the other 19 state religious freedom laws is the point of standing. In most states where these laws exist, which the exception of Texas, the government has to be a party to any claim of an undue burden on a person [corporation or religious organization’s] religious beliefs which are deeply held. So this means a person can simply to refuse to serve someone because their beliefs would consider that service a sin.

Now Mark Noonan attempts to clarify matters by saying that this law will discriminate against no one for a very simple reason and i will use his own words here:

“It would not allow me, if I were a baker, to refuse to serve homosexual customers – it does excuse me from participating in a same-sex wedding by making the cake which will be consumed at that wedding. If I were a baker – and being that I am Catholic – you could get just about anything you want form me…but you couldn’t get a cake celebrating a same-sex wedding. There are other sorts of confections you couldn’t get from me, as well…I probably would not want to bake a cake which, say, proclaimed some dogma of Christian Science. You just want a cake – you got it; you want a cake which requires me to sin: it ain’t happening.

And that is all RFRA does – it allows me to not do something for you. If I am not doing something for you then I am also not doing anything to you. I am not violating your rights by not providing a service. In fact, if you were able to compel me to do something for you, then not only would you likely be violating my religious beliefs, but you’d also be forcing me into involuntary servitude…and slavery is explicitly prohibited in our Constitution.”

It’s necessary to dissect what Noonan says here line by line so that his depth of misunderstanding can fully be understood. Noonan states he wouldn’t be allowed to refuse homosexual customers, but then he pivots to the fact that he wouldn’t bake a cake [still a cake keep in mind] if that cake was to be consumed in celebration of a same sex wedding. That in Noonan’s deeply held religious belief is a sin and no law can force him to sin. Okay, that does sound like a deeply held religious belief but it is also de fact discrimination. All other people celebrating legal weddings recognized by the state of Indiana can come right in to his bakery and order a cake but this other group cannot. Noonan has create a second class of citizens who are committing no crime under the law but now he, with the aid of Indiana’s RFRA, can discriminate with extreme prejudice.

His next argument is that if he’s doing nothing to you then he isn’t violating your rights. I disagree. Segregated lunch counters refused to do anything to black customers throughout the first seven decades of the 20th Century, yet those people’s civil rights were clearly violated. Noonan feels that Jim Crow in its modern incarnation when applied to the LGBT community is a farce. he’s dead wrong. What this law will do is commingle commerce with religion. At best these are awful bedfellows as was seen in the Hobby Lobby decision. You are violating the rights of a couple who wants to buy a wedding cake and yes this is a first world problem but it is also essential to having a free society, governed by laws not by religious feelings or beliefs.

Despite the dogmatic epic fails previous cited Noonan takes the full cannonball into the stupid pool with the last argument in which he says having to bake a cake for a gay or lesbian wedding would force him into involuntary servitude and that slavery is explicitly prohibited by the Constitution. He’s right that slavery is patently unconstitutional but engaging in a legal commercial contract to provide a product or service for pay is not slavery. Involuntary servitude is a different matter. The pay exchange is not the issue with involuntary servitude because one can be held in involuntary servitude and receive wages. The issue is with force. The legal definition states that their must be proof that the couple wanting the cake for their same sex wedding, “knowingly and willfully took action, by way of force, threats, intimidation or other form of coercion, causing the victim to reasonably believe that he had no way to avoid continued service, that he was confronted by the existence of a superior and overpowering authority, constantly threatening to the extent that his will was completely subjugated.” A broad interpretation such as Noonan’s would cast America into a legal tailspin in regard to where a person’s religious beliefs, on a litany of matters, come into to direct conflict with secular law.

BLOGS FOR VICTORY OFFLINE

The Internet child of Matt Margolis and Mark Edward Noonan, BlogsforVictory, which began as BlogsforBush a digital apologist for the unjust war in Iraq, is down as of midnight last night. There is no explanation I can find except they didn’t update their account at GoDaddy.com. I am sure they will whip out a credit card and renew the blog and return to their opining about what’s wrong with Terra from an authoritarian conservative perspective. This blog has fought many wars with them especially socio-political ones. The fact that Noonan cannot bear to see the nude human image was likely the reason anyone who worked for The Dis Brimstone Daily Pitchfork were banned from commenting there. If this is the end of BlogsforVictory I must admit a measure of sadness. Nothing made me happier than reading Noonan’s predictions of conservatives winning presidential elections only to see him have to eat his words on the following Wednesday. The hypocritical gut twisting the likes of Amazona, tiredoflibbs and Count d’Haricots were forced to engage in as the war in Iraq went south due to no WMDs being found. At the start of B4B back before the turn of the century conservatives likely thought they had a renaissance on their hands in the first decade of the new century. 9/11 reinforced that for them. Then the grand social pendulum started to swing toward the Progressives. Same sex marriage and abortion rights are still law in America even though the latter has seen states chip away at a woman’s right to choose. Over the last six years the two electoral victories of President Barack Hussein Obama has lit the fuse to the bomb that will eventually blow up the GOP and fracture the Right irreparably for at least a generation. BlogsforVictory, and blogs like them that required conservative ideological purity, have been more responsible for the coming demise of the GOP than any action by President Obama, Progressive elected officials or even Liberal bloggers like me. Maybe Noonan and his fellow travelers in theocratic conservative authoritarianism will rally behind a single candidate that they wish to see elected the nominee in 2016. Palin isn’t a favorite for Noonan; nor is Dr Ben Carson but I could see a BlogsforCruz2016 rising from the ashes of B4V in the coming months filled with the same improbable enthusiasm that they had for McCain and Romney over the last two election cycles. If there is one thing I can give them credit for after so many poor predictions is that they are consistent in their blind belief that they are the majority in the face of proof to the contrary.

A CLASSIC EXAMPLE OF WHY THE RIGHT IS WRONG

I had fleeting memory of Cindy McCain and Megan McCain being in an ad for the gay rights group NOH8 four years ago but this ad has burned an image in the mind of Mark Noonan at Blogs4Victory. Noonan an intractable Catholic conservative who is so concerned with his own immortal Soul that he would be willing to disenfranchise millions of Americans, deny millions more their civil rights and even deny health care options to every woman in America who would seek any form of birth control writes:

“I remember a while back ago when I saw a picture of Cindy and Meghan McCain made up in the “NoH8″ logo and it immediately occurred to me just how absolutely disgusting it was – while “NoH8″ had been around for a while, it suddenly struck me what it really meant – what the liberal fascists, that is, meant by using it: that anyone who disagrees with them is a hate-filled bigot, unfit for decent company. It told me, point blank, that by the mere fact of being a Catholic in accord with the Magisterium, I was the modern version of Bull Connor. Plenty of Republicans fell for it – after all, it was just about not hating, right? Perhaps not. Maybe the whole purpose of “NoH8″ was to get people to hate the “other” – in this case, anyone who disagreed with same-sex marriage?”

This is just the beginning of a post (which should be read in full to understand the lunacy of the right) that exposes what is wrong with the mainstream religious conservative in America. In one way he wants special treatment for himself and his beliefs despite not holding these beliefs all his life and not ever being challenged or discriminated against because of them. This is in stark contrast with countless black Americans, women and LGBTQ persons who have given their lives in their struggle for equality with self proclaiming religious white men.

Noonan, a Catholic is now on the same side of history as those who were in the Ku Klux Klan in their heyday at the onset of the Roaring Twenties. The similarities between the rhetoric, bigotry and desire for unearned privilege is almost without divergence. He makes a point that any conservative that disagrees with a Liberal who feels that LGBTQ Americans deserve the same equal treatment under the law as he does as a citizen will be portrayed as a bigot or worse, is a non-starter. Anyone who does this and stands on their religion as the proof and reason IS a bigot. It is the height of hubris that Mark Edward Noonan feels that his Catholic beliefs should strip the rights of anyone. This is the definition of bigotry; that one’s beliefs are a legitimate reason to hate.

This is nothing new coming from Noonan or from conservatives in America panicked that their unearned privilege has been exposed and that their numbers are dwindling. It is no wonder that he can bear none of my comments at his site no matter how civil or fact filled. He stands on his faith which he holds more dear than the rule power of the Constitution which conservatives swear they want America to return. This is yet another paradox for those who think like Noonan. It is not enough for him that he lives in a nation that is the most free in the world (despite NSA spying and runaway technological snooping by corporations) he and his brethren must rule; especially if it is at the expense of those who do not share his values.

THE KNOCKOUT GAME

The MSM is now reporting on a violent trend that has been in the conservative blogosphere for some time now. Conservatives, in their lust to show that American minorities are out for their blood, virginal daughters and property, have brought into the mainstream of American news a crime of violence mostly perpetrated by black youths called The Knockout Game. Mark Noonan at BlogsforVictory thinks that this game, where one tries to knock an unknown and innocent person unconscious with one punch to the head, is a by product of a shadowy but pervasive thing called “liberalism.” Noonan also states his belief that if America would just go back to the days when the Church ruled the lives of Americans and was unquestionable, when public office holders could not be ridiculed and women and minorities “knew their place” all the violence and fear that is now in the minds of Conservatives would be gone and the ship that is America would free itself from its wandering course toward prosperity.

We, Ourselves, of the Collective disagree with Mr Noonan’s assessment. Had he been living one hundred years ago We, and the Meditators, doubt that he would have written a similar article denouncing his Conservative and self proclaimed religious brethren for their bombing of Greenwood in Tulsa, Oklahoma or for the lynching of dozens of blacks in 1913. Noonan does not know the names of Henry Mouseon, David Rucker, Andrew Williams or Pastor Charles Tyson who suffered a far greater fate than being punched in the face by an angry and ignorant youth. The men and women and children who flocked to these spectacles, Conservatives all, were seen as people with the intestinal fortitude to “maintain order” at any cost. These were Mark Edward Noonan’s people then and they are the sort of people Mark Edward Noonan, the TEA Party and the helpless whelps of modern middle class white Conservatism poisoned by talk radio and email chains that play around the skirts of bigotry would choose to associated themselves with religiously, politically and ideologically. Maybe, just maybe, the Conservatives should consider the serious issues in their community involving the hundreds of gun related murder suicides and thousands of gun related suicides that are taking place in America annually before they fearmonger on the violent actions of those they feel are not worthy to be Americans?

THE TRUTH SHALL SET YOU FREE

It’s nice to see that Mark Noonan is back at Blogs4Victory. I find it a weird name for that blog because they really haven’t won anything save for the House in 2010 and this blog was called Blogs For Bush before the 2008 Presidential election. The rise of the TEA party energized the commenters and some of the posters after the election of Barack Obama but all the site has really done is tack more to the Right over the past three years. Now Mark Noonan the guy who hung his hat on the “collapse of the dollar” and the “implosion of the Chinese economy” is back with more “facts” for wingnuts.

In one of his first posts since returning to B4V he writes:

The thing about un-plugging for a little while – especially if you make an effort to really shut your ears to popular culture – is that in the silence, thought can grow. We are relentlessly bombarded through our waking hours by sounds and images created by others in an attempt to get us to say or do something we might not do purely voluntarily. This bombardment comes at us so fast that we do not have time to reflect upon what we have just seen – if you do desire to think about things for a moment, another sound or image is thrown at you, demanding your attention, and thus destroying the possibility of thinking through the immediately preceding sound or image.

If you shut your ears to popular culture you are in essence admitting you are out of touch. I know Mark, you’ve had some struggles with a certain elelment of pictures and videos that are out there on the big bad Internet, but that doesn’t mean that less information is better than more. I don’t think the Internet or the digital media is intended to get people to do or say things that they otherwise wouldn’t. if you have a weak mind that might be the case. It’s my opinion that these tools, and that’s all they really are, exist to provide more information. Some of that information comes through a filter of the provider’s choice whether that be economic or ideological and some is quite raw leaving opinions up to the reader. An intelligent person can figure out the difference.

What most people are looking for in this buzz of info is the Truth. It’s capitalized for a reason because truth can become what the writer wants it to be rather than what it is universally. Religion and politics can reduce Truth to truth in a New York minute, or nanoseconds by today’s fast moving standard.

As Noonan’s return article continues I’m given the impression that he feels no love for advertisers. The thought that BBDO or Saatchi & Saatchi “bamboozle” people into buying Crest vice Colgate toothpaste is childish at best. But isn’t this what conservatives like the most simplistic and base explanations for those things that they can’t understand? What this portion of his article does tell me is that Noonan isn’t a proponent of information freedom or of the People having a thing called Choice.

Conservatives loathe choice. They would prefer to have there be no Brand Y since their product Brand X is all you’ll ever need. They feel this way about women’s health, religion, race, foreign policy . . . Well you get the picture. One key tenet of Liberalsim is Choice. The freedom to do what you choose within the law is they very basis of Liberal belief. It’s not always the most correct path, but it does provide the most options.


In Hindsight

I didn’t expect anything better out of Mark Noonan and I must admit it’s good to have him back on the barricades shouting for the right for conservatives to tell everyone else what to do, how to act, whom to marry and just how good it is and how fortunate the middle class is to have a 1% who don’t carry as much water as ther do.
